  • The attorney is the person appointed by the donor to act on their behalf. This role carries legal responsibility and must be carried out in the donor’s best interests.

In the context of a Deed of Revocation, it is always the donor who has the legal right to cancel or withdraw the authority previously given to the attorney.

When should you revoke a power of attorney?

You might need to revoke a power of attorney if:

  • The attorney is no longer able or willing to act

How to revoke a power of attorney

  2. Sign the deed in the presence of a witness. The witness must be at leaste 18 years old and not a beneficiary or involved under the Power of Attorney or LPA.
  3. Inform the attorney in writing that their authority has been revoked.
  4. Notify any institutions or organisations that may have relied on the Power of Attorney (e.g. banks, HMRC, local councils).

If the power of attorney was registered with the Office of the Public Guardian (OPG) in the UK, you should also send a copy of the Deed of Revocation to the OPG along with a written request to update their records.
